Prime's legal troubles began with concerns over its ingredients and marketing practices. Plaintiffs allege that Prime Hydration drinks contain dangerous toxic chemicals and that Prime Energy drinks contain dangerously high levels of caffeine. It is also alleged that the company marketed to children who could be greatly harmed by the products. These allegations have led to class action lawsuits against the company.

The first class action lawsuit centers around the alleged presence of per- and polyfluoroalkyl substances (PFAS), often referred to as "forever chemicals," in Prime products. Lawsuits have also been filed over excessive caffeine levels in Prime's energy drinks, raising questions about the company's transparency and consumer safety.

Prime Hydration Lawsuit: PFAs in Prime Hydration Drinks

A class action lawsuit was started by California resident Elizabeth Castillo, claiming that Prime failed to disclose the presence of PFAs in its products. Sometimes called “forever chemicals”, PFAS are not naturally occurring and have been linked to a variety of health problems.

According to the National Institute of Environmental Health Sciences, exposure to PFAS can lead to increased cancer risk and decreased ability to fight infection. The Environmental Protection Agency has additionally cited research tying PFAS to reproductive health problems, developmental delays in children, increased obesity risk, and hormone interference.

The lawsuit alleges that Prime deliberately misled consumers by marketing its products as safe and healthy, while not disclosing the presence of PFAS. According to testing funded by the plaintiff, the grape flavor of Prime Hydration contains PFAS roughly three times the amount allowed under FDA regulations for drinking water.

Prime Energy Drink Lawsuit: Caffeine in Prime Energy Drinks

A second class action lawsuit was filed against Prime by a woman who claimed that Prime Energy drinks were deceptively marketed as safe for children. This lawsuit cites a combination of California and Kentucky laws. The complaint alleged that Prime failed to adequately disclose high levels of caffeine in the product that could be damaging for children.

In August 2024, the judge approved Prime’s motion to dismiss the lawsuit. However, plaintiffs have until mid-September to submit an amended complaint which may keep the lawsuit going.

Another lawsuit alleging Prime Energy drinks failed to disclose caffeine levels was filed in New York in 2024. This is also a class action lawsuit. It has since been consolidated with additional claims that allege similar harm.
